IN ALL CASES, JET'S KITCHEN'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE AMOUNT YOU PAID TO JET'S KITCHEN FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Kitchen and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Users in California acknowledge that their rights may also be governed by the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as well as the California Business and Professions Code. All users acknowledge that consumer protection matters may also be subject to oversight by the Federal Trade Commission (FTC) under the FTC Act (15 U.S.C. § 41 et seq.).

10.2 Binding Arbitration

IF THE PARTIES ARE UNABLE TO RESOLVE A DISPUTE INFORMALLY, ANY CLAIM, DISPUTE, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE BREACH THEREOF, OR YOUR USE OF THE SITE OR SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding on both parties. The arbitration shall take place in the United States, at a location mutually agreed upon by the parties or as determined by the AAA.

10.3 Class Action Waiver

YOU AND JET'S KITCHEN EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If any court or arbitrator determines that the class action waiver in this section is void or unenforceable, then the arbitration agreement shall not apply to class action claims, and such claims must be litigated in a court of competent jurisdiction.

10.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims regarding intellectual property rights, including copyright and trademark infringement, are also excluded from the arbitration requirement.
